A club just opened directly below us and I can feel the bass from my bed! I've contacted the DEP, my community board and the boys at the 77th but only in an effort to collect information. I've only filed one noise complaint because I'm scared of the guys that run the place. I've seen them conduct illegal business on more than one occasion. Who's to say that my home won't be broken in to or worse? If I challenge these guys' livelihood who knows what they'd do? They just sunk alot of money into the place to get it opened. Oh, and my landlord? refuses to help; calling these guys directly does nothing and I haven' sleep in weeks!!! Anyone heard of or dealt with similar circumstances? Just for the record, I've lived here 3 years before these guys moved in AND it appears that the building is zoned for manufacturing, we're not even on a lease.

You can make noise complaints to 311 anonymously, although those might not get you far. One thing you can do is to check out the city websites and make sure that the club is following all the laws for its operating hours, patio, etc. If they're breaking any of the rules, those are sometimes easier to document/observe than noise. For example, we lived above the local undergrad bar at Columbia for 3 years (at the time, couldn't afford to move). The one thing that saved us is that we learned they could not keep their sidewalk patio open past midnight on weekdays and 1 am on weekends (they'd been keeping it open past 4am every single night, and we were on the second floor right above the tables). The bar's landlords, Columbia, didn't the bad publicity of too many complaints so they made sure they followed the basic rules. Never did get the noise from the music addressed.

If you're living in a building that's not zoned for residential use, it's probably best to start looking for a new apartment.

You need to find out if the building has a C of O. Although a building without a C of O can be legally used for what the area is zoned for a conversion to a club would require a C of O and Place of Assembly Permit. go to http://www.nyc.gov/html/dob/html/home/home.shtml and see what the status is. If there is no C of O, then the club is most likely illegal. Fire Department can shut this kind of stuff down quite quickly. Forget noise complaints. Unfortunately, if they are legal than what Carnivore says is true. If there are other people living in the building you might be able to make the case that the LL knowingly rented illegally for residential use. He can't plead ignorance of the living situation, especially if it's been going on for years. You would need a lawyer and time. The best outcome would be to extract some money from the LL and move.

Yeah that's it, call the DOB. That will get you an order to vacate and I'm sure you can find a nice quiet to lay your weary head in. You moved into an illegal apartment and I'm sure the shadiness was reflected in your discount rent. You moved above a place of business and are surprised when they conduct business there. Cut your losses and move. For the record I'm not surprised at all that the landlord doesn't give a shit about you. They're a slumlord and the club downstairs is paying alot more than you are.

Who said anything about calling the DOB? If the DOB showed up in 99% of the cases they issue a violation stating that the building is being used contrary to the C of O or zoning. Short of imminent danger a vacate order is rarely issued. Fenian, you watch too much TV.

honestly? move. i know, you have lived there xx years. you shouldn't have to move. the other people are wrong. etc etc. do you want to be right or do you want to be happy? more so, do you want to get into a pissing match that you likely cannot win that could put your well being in danger? the only thing i would do is make sure your landlord knows this is why you will be breaking the lease, and have copies of EVERYTHING. it's not unlikely he'll be glad to get rid of the tenant who complainswhat would you tell me, if i could hear you speaking?--t.r.

there aren't any clubs on washington that i'm aware of...i used to live across from 95 south and it was awfully loud...so i moved.

Hmmm... if I had to guess, the poster might be talking about the place that opened in the former Chanel's space on Atlantic between Vanderbilt and Washington. But this is a totally uneducated wild guess.

brooklynpotter may have the best solution -- move and be done with it. if you can. if you want to try to fight it, nyc does have strict noise ordinances although it's difficult to win on those grounds. nuisance complaints and breach of habitability are more effective. you can find the city noise regs here: http://nyc.gov/html/dep/html/air_and_noise/index.shtml and an article with advice for tenants here: http://www.tenantsservices.com/art_nyc_noise.php as far as complaining to 311 goes, anonymous noise complaints are recorded but nothing is done about them. you have to give your name and address for them to follow up. there is a procedure they go through -- first sending a letter to the noisemaker, then another, and eventually maybe a citation -- but you have to be persistent and keep filing complaints and keep a record of them. good luck."Here's a little tip I would like to relate: Many fish bites if you got good bait."
