Unemployment question

      The NYS Dept of Labor make me cry. Perhaps someone can help me.

      I was laid off from my full time permanent job on Oct 30, 2009. However, I am working a couple of evenings a week at a seasonal holiday (i.e. temporary) job. My questions are:

      1. Can I claim unemployment whilst I continue with the part time seasonal job? Will I get unemployment to make up the $$ difference between what the seasonal job earns and what I would get if I was claiming full unemployment?

      [1.a: If yes I can get it, how? The website/phone line lead nowhere....]

      2. If I increase my hours at the part time seasonal job and make it full time seasonal (so still temporary - ending about Dec 20, 2009), will I be eligible to receive full unemployment benefits when the temp job ends? Does the Dept of Labor only calculate eligibility based on the most recent full time job? If it does, there is no incentive for me to increase my hours on this temp job, as when it ends, I'll get nothing....

      3. How do you contact anyone at the Dept of Labor to ask them any questions???? You either get lost in an endless phone tree, or clicking anything on the website, but never getting the answer/telephone/address so that you can get in touch with a real live person.

      All info gratefully received. (I'm off to that seasonal job now, so won't get a chance to look and see what if any replies there are for a few hours.)

      If they are being lousy via phone, you might have better luck seeing them in person.

      They have an office near Juniors on Flatbush, (they see walk-ins).

      Sorry, I don't know unemployment regs well enough to be of any real help

      !!! I couldn't find an address for an office anywhere! Even 311 didn't know. Do you know the address?

      I'm almost 100% sure that if you get ANY job you can no longer collect unemployment. Ive never filed but know many people who have not taken part-time work because they said they would lose their benefits.

      Go to the office at Metrotech, Nomad, nothing is better then talking it out with them in person. But yeah, I haven't even tried for a parttime job because as far as I can tell, my benefits end and I'm still happy as can be on my Funemployment vacation... until it ends of course

      Go claim now! Do not pass go, do not collect $200. It is important that you file the clam as soon as you are laid off. You benifit is calculated on the previous full quarter in which you had the highest earning. Your benefit lasts for 1 year.

      Yes, you can work part time and collect unemployment, no problem, as long as you answer the question Yes I am still looking for full time work

      When you first claim they figure the $ amount of you benefit and decide by 26 that is how they calculate the amount you receive weekly. When you get paid, your benefit pool gets reduced by that amount.

      When you work part time the amount you get paid that week reduced by 1/4 for every day or part of a day you work unless you earn a total of $406 or more in which case you will not get paid for the week from UI. If you work 1/2 day and get paid $500 you get no UI for that week. Note that because you are not getting UI you benefit pool for the year is not reducing either. This makes your benefit last longer. It also goes to your earnings so if you are still unemployed on the anniversary of your 1st filing you can refile for a 2nd year.

      If you do take the full time work temp, and the work stops before the anniversary of 1st filing then you will reopen your existing claim.

      there might be some exceptions to this if you are working nights and week ends but for that you will have to talk to someone. When you do take notes and get the name and ID of the person you spoke with.

      And yes, it is hard to talk to someone but If I remember if you call to certify your claim for the week instead of using the web then you can get tom someone, it takes patients, call about 1/2 hour after they open. you will have to wade through the VRU prompts but at some point after you are given just wait and after20 seconds of silence your here, oh yea by the way if you need to talk to a person dial X.

      But go file now, do it over the web, it is painless

      BTW you will have to go to DOL they will give you an appointment after you file and be prepared since their place on Schimerhorn (SP) was under renovation and they are in a high security federal building on Fulton

      I'm so sorry you lost your job, Nomad. One of the worst feelings, for sure. I'm glad that you have at least a little something to keep you busy in the meantime, though. ALWAYS better than doing nothing. Also, knowing what little I do about you, I know you won't just sit on your laurels and you'll find something great sooner than later. One door closes....

      Goddammit I've spent too much time thinking (and worrying) about this - I should've just come here to the font of all knowledge ages ago!

      I see someone answered your questions but in the future the DOL has a facebook page now. It seems like if you post a question on there you stand some chance of getting a response. As opposed to the phone where you stand almost none.

      Never post, but sorting through unemployment issues can be so disturbing I thought I'd chime in with a couple of points since I went through this last year/beginning of this one.

      1. The address posted a few posts above is a 'Workforce' center. They help you get a new job, they do not help you apply for unemployment. Some employee might answer questions you might have, but that is not their job.

      2. If you call 1-888-209-8124 up to 1 minute after they open (8:00 am) and you patiently answer all the prompts till you are offered the choice of a representative, you WILL get a person on the phone. I have made such calls around 4 times for various reasons, and the representatives were always extremely helpful and efficient. If you call later, they will probably tell you that due to volume they can't help you, and they'll DISCONNECT you.

      a few points/questions:

      1. yes, you can claim while you are doing part-time seasonal work. as the previous poster said, if you work 2 days/week you will get 50% of your weekly maximum.

      2.they do not calculate only (or at all, in the case of something that will be over by 2010) based on your most recent part-time job. for how long were you employed at your last full-time job? you were laid off during the last quarter of 2009, which means that to calculate your benefits they will skip the 3rd quarter of this year, then use the previous 4 quarters.* if you weren't employed all 4 of those quarters, and you can hold out, best to wait until january to claim. if you were employed at a rate equal to or higher than your ending salary all of those 4 quarters, best to get the claim started now, even if you end up going full-time temporary for a month. there is a one-week waiting period before you can start to collect.

      *"a base period [the period on which your benefit is based] is the first four of the last five completed calendar quarters prior to the date the initial claim is filed. the base period becomes effective on Monday following the First Sunday of Each Quarter."

      Thanks for all your tips.

      I went to the place on Fulton, and they told me there was nothing they could do for me.

      With my paltry 15 hours a week part-time temp gig I'm not eligible for any unemployment, it seems.

      Good to know that they'll use my full time job to work out my benefits.

      And thanks for the tip about calling at 8am. I might try that.

      So sad to say, I think it's in my financial interests to give up the part-time work and become full-time unemployed.

      ...Hope that something more fantastic than the old job turns up soon!

      I think that if you divide your unemployment pay into 5 days, and subtract that amount into how many days you work, that'll give you the number.

      So, say it's 450 for the week- that's 90 a day. So if you work 2 days, your going to get 180 deducted from your unemployment.

      well in new york the max benefit is $405 per week - ineed to know how to figure out the weekly benefit - before accounting for any part time jobs while on unemployment

      Oh, ok. Generally speaking, you get the max if you made a minimum of 50k while employed. The only way to truly find out is to actually apply.

      yea that's what I thought too, but I know people who definitely made more than 50k but say they are getting less than the max benefit.

      so who knows.

      i still say it's bullshit that they deduct taxes from your benefits.

      Back in November when I started this thread it was all as clear as mud, which perhaps is how you (vidro3) feel. However, I recommend applying, as then they send you a bunch of mail telling you what the amount is that they've calculated you'll receive, and how they reached that number. Once I got all that info, I decided it was best for me not to claim until Jan, which is what I did. So far all has gone smoothly, tho' I did get called in for a mandatory meeting at the Fulton St office. I wonder if that was triggered by my initial claim that wasn't followed up. But as I'm all legit, it was fine.

      That mandatory meeting is something that everyone has to go through- its just to make everyone aware of the services that they offer, blah, blah. They want to make sure you don't have any excuse to just sit on your ass all day not looking for a job.

      Ok, so I guess all has gone fine then. Well, being unemployed isn't fine, but at least I'm getting my insurance.
