    I had rented a commercial space from them, and possession of space was supposed to be in feb 2008 but they were in court with previous tenant and assured me they would be out by March. But turns out they didn't vacate until June! Sol & Zeev knew that the court would drag out and they lied ! Now they are refusing to give back my 2 months security even though it was their fault and they already have another tenant who I'm sure also gave them 2 months security! Not to be trusted as far as you could throw them!

    My sister and I are taking him to small claims court tonight. I just googled his name out of curiosity and am blown away by what I see here. Am going to print a lot of this and take it with me. We told him to f-off and moved out and he's keeping my deposit. I intend to get it back. He's disgusting.

  • Sounds like he's hoping to run folks out so he can sell it. There are flippers who want to buy those homes (like they finally did with 219, next door) and the owners want the big bucks. If the tenants leave of their own accord, saves him the trouble of trying to buy out the rent controlled/stabilized tenants.

    It might be that not paying rent for a while (and saving that $$ to move) wouldn't hurt him enough to take you to court so long as you leave.

    Sucks, big time. One day of no heat or hot water is bad enough, considering where we live and that's 2010, but what y'all are going through is unbelievable.

    For legal purposes I believe you have to have proof that you are keeping the rent money in escrow in an account somewhere, so there is proof that you had intent to pay and were holding up your end of the contract but were protesting his breach of contract.

    It diminishes your case if you spend the money and aren't able to prove that you kept but withheld the money due to failure to provide reasonable services.

    Even if you are looking to move out now, he could probably sue you for unpaid rent and might get the judgment if you have no proof that you set it aside in protest.

    No expert, but I seem to recall hearing that's the case.

    I am in the process of suing S & Z corporation for not giving me back my deposit.
    Would anyone be willing to provide the address the rent checks are sent to and the bank acct info when the checks are cleared? My lawyer is unable to proceed without that info. Also if anyone knows Sol Steinlauf or Zeev Sandman's personal address, that would be much appreciated.
