If you are under an unregulated lease and your Landlord has benefited from the J 51 tax abatement, basically passing on improvements in order to get the base rent over $2000, than it may apply to you. Improvements in the apartment may not be evident. Maybe he replaced an old boiler or something like that. I'm not entirely sure.
