FIND OUT IF YOUR BUILDING IS RENT STABILIZED

Here is a link to find out if your building is Rent Stabilized:

If youu find out is is, the next step is to go to DHCR to find out your rent history. DHCR is located at 55 Hanson Pl behind the Pathmark at Atlantic Mall.

Bring your lease and ID or a utility bill to receive a print out of the rent history from 1984 0n.

  • I've already done this and here are a few things to know.

    If you find are you being overcharged (do a search on this forum for rent overcharge), you can file for a rent overcharge form.

    HOWEVER, if you lose, the owner can then boost your rent from the preferred rent (lets say 1200) to the LEGAL rent ...that could be something like 1900

    Quite an increase for one year, eh? You might think "well, where does that get him? he has to look for another tenant and get 1200 anyway because no one will take it for 1900."

    Not true! After every new tenant, a landlord is allowed to boost the rent up by a certain percentage.

    I recently found out I am being overcharged, but I do not trust my management company either. I will pay the rent they are issuing me, but the form is retro active! So when I know im moving out, I will apply for it after I sign my final lease. So if I am there for 4 years, I will get back the money I shouldn't have been paying for all those 4 yrs.
