They arrested him ON HIS PROPERTY or so I saw and heard.
I don't think being "mouthy" warrants an arrest. Have you ever been to a protest rally, particularly ones that are mostly attended by whites, like PETA. Those cops put up with a lot of mouth, but dont seem to eager to arrest folks... -

As for Gates, I wonder what went on in his house. He seems sort of pretentious to me. As someone who works in academia, I have SEEN my fair share of black professors who bitch racism at any little thing, but are the first people to treat everyone else with high handed disrespect.
that's what's so galling about the editorial quoted above: probably gates could have appeased the cop by behaving differently, but the suggestion that failure to act that way somehow justifies arrest is another thing altogether.

you know you are right.. I stand corrected. Hollywood actors and drunk fratboys are routinely rude and obnoxious, but most cops won't arrest them, cause being an asshole is not illegal -

I dont know much about hollywood actors, but I know MANY a drunk fratboy who has been arrested. And I know many a whiteperson who has been arrested for mouthing off, being "defiant" and generally being difficult to deal with. Maybe its just me.
Mouth off to police= get arrested. I, as a rational citizen of this country, realize that if I get approached by the police that it is prudent to be courteous, which does not necessarily mean rolling-over and volunteering the sacrifice of my constitutional rights. One doesn't need to be a dick to not be a doormat. -

Undoubtedly true, but only because police routinely abuse their authority. -

Yes, as I wrote, they arrested him on his porch (not "WITHIN ONE'S OWN HOME" as you originally wrote - "within" meaning inside the house). Also, as I wrote, legally, there is a difference. It will all depend on how the law is written but if he's within sight of others who he might incite (i.e., on his porch), the cops will have a better argument for why they arrested him (because, they would argue, he was inciting a crowd).
No, it's not a crime, per se, to be mouthy, but the cops have different legal arguments (inciting a crowd, disturbing the peace) when someone gets mouthy. And, sorry, but the anti-Republican convention was full of hundreds of white folks getting arrested just for being there so black folks (and/or Gates) haven't cornered the market on being arrested for no reason. -
Maybe.. but I treat cops with the same courtesy that I would any normal serviceperson. Why should I treat them with any less? Rationally, not because they have the right to ARREST me... i'm nice to servers, bodega owners and homeless people. I'll be nice to cops, especially because they have handcuffs.
