Trader Joe's is at Atlantic and Court. This intersection is closer to Sahadi's. I would also consider Atlantic and Court more dangerous than Atlantic and Clinton. Regardless, this is sad.

When I first saw this, I thought it happened at the Clinton place/ave/st that is near Vanderbilt and Atlantic. (Nope!)

To me, that area seems more dangerous for peds than the one near Trader Joe's and Sahadi's.

that intersection is a sh.tshow.  speeding cars plus peds running across. 
cars speeding where? to get to a jammed highway faster?
peds jaywalking where?  to get to their trader joes goodies faster?

I am not going to use the term "criminality" with regard to jaywalking.

But I will state that the pedestrian is being blamed, and the police have decided to not take any  legal action against the driver.

[For the sake of couth, hopefully the insurance company for the driver doesn't try to take action against the estate of the deceased pedestrian]

The driver had the right of way (green light) and the victim was outside of the crosswalk. Those two factors make it such that its hard to show some criminal behavior on the part of the driver. Unless someone comes forward and reports that there was excessive speed (which it does not seem is the case) I'm not sure how you get to criminal negligent homicide.
