SIGNED LEASE, Gave money, BUT still no key!!

Hi,

I signed a lease for an apartment that is still under renovation...

The apartment is close to complete barring the installation of the appliances (they weren't there when we did the walk thru), toilet bowl, the fixing of the rickety stairs with nails sticking thru (it's a brownstone), and countertops.

Fast Forward.....I took a leap and signed the lease. We also gave him a certified check for a lot of money.

Our lease date is for 15 June. The landlord did not give us the key and claims that he will give it to us when the apt is completely done and that since our move in date isn't til the 15th he actually doesn't have to.

That said,,, lease signed, money forked over aaaaand,,,,,,, no key!

Does this sound odd to anyone? Cause now 3 days later..... I'm feeling a little less confident with my decision. Is it unheard of to sign a lease, give money, and not get a key? (although it's our lease period is still a week away...)

any thoughts are appreciated.

  • Nothing for you to worry about. I usualy give out the keys when the lease is signed. However, if work needs to be done I would like to hold on to the key until the work is finished. If someone gets hurt in the apartment before the work is completed, I would be liable. I am sure you will get the key on or before the 15th.
  • Its quite normal to not get keys until a day or so prior to move in.
    alot depends on situation, sometimes previous tenant moved out the morning b4 , it gets cleaned and painted that afternoon, and you pick up key as you pull up with movers ...

    If you wanted to move in June 9 , and the LL could accomodate,
    im sure (s)he'd have been happy to get your extra weeks worth of rent.

    In any event, often times when workman are going in and out of an apt, the LL will change out the cylinder to a master lock that the contractors have. Once the work is done a normal cylinder is put in.

  • Aye, I feel your pain. I am looking for a spot myself and have already caught a few craigslist scams. I am kinda TERRIFIED of by owner listings. So I have started flipping it on them. Since they can interrogate me, I can ask them to show me the deed proving they in fact are the owner of the building. They don't seem to like it too much but I really don't care.
