  • Why is creating a will sad?? What's sad is if you don't have one, no matter how old or young you are.

I'll check the name of the attorney who I used when I get home, but also look into on-line resources...

  • Nothing sad about having a will no matter what age you are.
Most of the time these documents are straight forward and the choice of the lawyer is not so significant. But I think it is more pleasant if the lawyer is personable because you are discussing family matters and you need to be comfortable. A "good lawyer" is one who understands your intent and is scrupulous enough to cast a document that is tight and reflects your wishes and intent.

I am not a lawyer but I have the gene... come from a family where everyone was an attorney so absorbed a lot of information eves dropping when I was a kid.
  • I have heard good things about Peter Noto on Atlantic Ave. but have never had any dealings with him. If you do not find some one locally I do know an attorney in Manhattan who you can speak to.

I would just like to add for personal experience that it is also important that you should have a health care proxy and power of attorney drawn up at the same time. If a family member becomes incapacitated it helps to have these papers to carry out their wishes.

A second on the healthcare proxy and living will!
And if it's not too complicated - as was previously pointed out to me when I asked this same question a few years ago - you can make a valid will without a lawyer with a kit from the bookstore.
  • I used an attorney in Manhattan - Clifford Meirowitz/W 44th St/212-764-1261

I third the health care proxy and living will urging - I did mine with forms I got off the Internet - had them notarized and witnessed at work.
