Parking ticket question

I'm not sure what the amount is. Probably about $250 or so of tickets in judgment before a city marshal will tow. That means at least probably 3 tickets that are over 90 days old with no action on your part. You can look up your plate number on nyc.gov you know. If a hearing is pending they will not do anything until it is resolved. You don't pay until they make a determination as to your accursedness.

It was probably a stupid question - but with the city agencies not communicating with each other one never knows. I'm hoping for the best. Whoever wrote the ticket identified my car as a blue 1999 (my car is green and a 2000) - a technicality? Sure, but if I can get out of it, I will.
-
as far as i can remember incorrect model year is not grounds for dismissal of a ticket.
incorrect color definitely is not grounds for dismissal.
if you dispute the ticket they may reduce it. -
agreed the color is not grounds for dismissal. If the year is clearly stated on the reg. sticker you might have a chance. Much better to go in person than dispute on line or mail however.
-
Well crap. Rain on my parade, why don't you?? Let's see how it plays out. They get enough money from me, maybe they'll throw me a bone.

YOUR TICKET WILL BE DISMISSED.. ANY "INCORRECT" INFO ON THE TICKET = DISMISS
I GET LOTS OF PARKING TICKETS SORRY TO SAY AND IM BOUT 98% SURE OF THIS.. BUT ITS ALWAYS BETTER TO FIGHT THEM IN PERSON !!! -
This brings me to my next question - I requested the hearing online and assumed I'd have to show up in person for it. Is this not the case? Should I have shown up on the address listed on the back just any time and fought it? I've never disputed a ticket before so I have no clue how any of that works.
-
yeah i mean its right downtown brooklyn and it really doesnt take as LONG as you think. but normally any error on the ticket results in automatic dismissal... i think the online hearings are different ive never done it but it ALL takes place online from what i understand.. but from what you said they made an error so the ticket is wrong and NOT technically your car. so you dont have to pay.. just waste your time. and that sometimes costs more than the ticket

no, "any" incorrect information does not equal dismissal. only certain errors result in automatic dismissal. incorrect location, license plate, registration expiration, body type, and a few others.
the department of finance says that they automatically check for these errors and automatically dismiss tickets with mistakes. But I would not rely entirely on their checking. I would not waste my time contesting the ticket in person.
you should plead not guilty and write a letter stating the ticket should be dismissed for incorrect color, car year, and try to come up with one other spurious claim.
worst case scenario: they say nice try you are still guilty and pay the original amount.
best case scenario: they say nice try you are still guilty and pay a reduced amount. -
This one happened to be a handwritten ticket. Most of the ones I get are those nifty machine printed ones. I'm not sure if that will make a difference and I'm sure the machine ones are taking over due to the inaccuracy of the handwritten ones as well as the ease. Well, now I know better, I guess.

see we have 2 different tactics here, because me personally ALWAYS just go downtown waste 20 mins of my day and either get it dismissed or just reduced. either way you never have to pay the full amount if you go downtown and handle it. and in most of the cases ive had with tickets esp the handwritten ones they are ALWAYS thrown out due to mistakes of who ever wrote them -
i've never had the pleasure of contesting a ticket in person but I always imagined it would be a long tedious process.
-
Any incorrect info on a ticket usually gets the ticket dismissed. Wrong car and color means dismissal. At least it did years ago.

that's never been the case. maybe de facto, but not de jure at least.
This is a pamphlet from '99/00 put out by department of finance that describes which errors can result in automatic dismissal. color and year of car do not matter.
I would save it.

It's not too bad and definitely worth it. We've gotten 3 and had two kicked - one of them had the car parked in Prospect Park when it was really on Prospect Park West and in the other case a scaffold had obscured the sign. Had to do a little photography for that one. -
Well, at the least, I hope it gets reduced. If I'm able, I'm going to try to get a picture of the blue car (that's just like mine) on my street - with the street sign in the pic argue that point.
-
well like i said Ana.. they reduce automatically when you show up. its a 30% reduction
-
The moral of the story is that I have to stop being a lazy slug and get off my ass to move my car.
-
ahahahah yes.. true story... what time do u have to move where you live?
-
Four freakin' days a week!!! Mon/Thur and Tues/Fri. It's effin' retarded. I wouldn't care so much but there are days when I can tell it hasn't been swept. While parking is much better in my nabe than in Park Slope, it's still a pain in the ass to move it so much.
-
dammmn you live in the WRONG part of bklyn holy shit there is NO way i could deal with that .. you may just have to park n the slope and walk home.. cause thats intense !!! 4days a week.. fuckk and i know they be so pressed to write tickets you gotta move at like 9:30 and you get the damn ticket at like 9:32 thats wack
-
Ours is 8:30 (I think) to 11 on the ave., 11:30 to 1 on the streets. ALL of my tickets are issued within 3 minutes after the start time.
-
with parking tickets you are guilty until proved innocent.

Subject: Dear Friend, know this
You are not just a small person against the big government,
looking to get a bone thrown, and otherwise paying your
tickets and obeying.
The main reason you go to court and request a hearing and
dispute your ticket is to waste their time. Imagine 1000s of people doing that. The judges salary would have to be as high as yours
as he is spending the same amount of time as you.

Wow. You've got me all figured out! I delighted in paying all the other tickets I've received since I've lived in New York but this one time, I just really wanted to waste someone's time. Believe me, I'm POSITIVE the judge's salary is far more than mine.

im probably resurrecting an old thread, but BOTH are definitely grounds for dismissal.
incorrect color definitely is not grounds for dismissal.
if you dispute the ticket they may reduce it.
Even if the cop has chicken scratch on the ticket and the judge cant read it, you can get it dismissed.
thats why they have digital ticket printers now
