Once again I agree with Potter. I checked tenant.net on your behalf today and they give two options: Take deductions from your rent and expect to get sued by your LL for non-payment, or take your LL to court. Personally, I would take your LL to Housing Court and sue his ass off (or let him try and take me to court for making deductions from my rent for basic rights according to my lease and the laws of New York), but if you're not into that/or can't because of your current situation, call 311 every day and at least make his life miserable. Just make sure you document everything whichever course you take. You must have seen Judge Judy. She likes documents and proof.

Thanks for the ass-kicking offers. Let's hold off until I see how tomorrow goes. If I am still without heat by tomorrow afternoon I just might consider getting rough!

As far as 311, I have been calling and keeping track of every call with them, as well as every call and e-mail, etc. with my LL. The heat better happen tomorrow or my log is gonna get so long I might need to consult an attorney! Enough is more then enough dammit. -

Yes, but when I talked with them about what was going on they said they would definitely file a complaint, but that I might want to give it one more day to see if they really do take care of it so that I don't "cause irreperable damage to my relationship with my LL."
As far as I'm concerned tomorrow really is D-day. It better be fixed and that is it...end of story or the real battle will begin -
littlegal, you are being too nice. it is not against your lease or the law to call about heat. trust me when i tell you this: you can call every day, even if the heat is scalding, and find yourself without penalty.

I threaten to withhold rent basically every time my management company dicks me around (not fixing my radiator, not spraying for bugs when i moved in and the place was infested, not allowing cable access to the building, faulty wiring...) They get 2 days to respond before I threaten to withhold rent (which I have only had to do once but would do again.)
My rationale is that they're most likely not going to sue me for withholding rent for something they're LEGALLY REQUIRED to provide because that opens a whole new bunch of issues for them. So far it's worked (and everything I've complained about has ben 311-able.) I would def, def, DEF heavily consider threatening to withhold rent, especially since it's towards the end of the month. Tell them you'll pay them in cash as soon as the heat is on, but not a day before. I can almost 100% promise you it is NOT worth it for them to take you to court, especially since this is something your legally required to have. There's no gray area.
If you need someone to draft you a passive aggressive and nice-but-forceful letter to certified-mail to your landlord, let me know. I've written about 6 of them. -

seriously, withholding rent always results in someone being in my apt SAME DAY. Landlords are deaf...until it comes to rent money. -
No, I didn't go straight to Target after being out of town. I went to Target when I was out of town. I was in suburbia. I did Target and Petco. Then I didn't know what else to do :-(
(ok, I had to do a team dinner and company meetings, but if I didn't have THAT to do, I would not have known what to do with myself after Target) -
And the Housing Court is notoriously hard on LLs and lenient on tenants when it comes to issues like heat. If he's a lawyer, as you say, he knows that and thinks you don't. He's bluffing.

Oh yeah, then that totally makes sense. I'm originally from Ohio and whenever I go back, it's Target and Bennigans. And the Targets in Ohio rock. Not like here.

target allows their pharmacy employees to deny prescriptions if they are morally opposed--like birth control, etc. (this is not allowed under NY state law, so it cna't happen here. but the target policy allows this where the law allows it. i won't walk into one till the policy changes)

Well, the update so far is that both the plumbing company and the LL's maintenance guy (who is actually very nice despite the fact that he works for a jackass) are here. They've been working since a little after 9. All i have to show for it so far is no water and me in my warm, fuzzy jammies, but I'm hopeful...

I hobbled down three floors with my cane and told them my sob story about having back surgery, being on bedrest, and freezing for the last two weeks. They were amazed it had been going on so long and were really sympathetic and nice about the whole situation. That was an hour ago.
About ten minutes ago all three guys came up here, bled my pipes for me, and promised it was really fixed this time. They even gave me their company card just in case and wish me a speedy recovery.
I FINALLY have heat!!!!! :cheers: =D>
P.S. My LL still sucks...and always will in my eyes. -
Keep a couple of space heaters as back-up just in case. They have been my salvation many times!
