Time Warner Cable is About to REALLY Suck!

Time Warner and Viacom are unable to come to terms regarding the carrier fees for Viacom's 19 channels, including Comedy Central. As of 1/1/09 at midnight, Viacom will discontinue service of their channels to TW subscribers.

What an awful way to ring in 2009. It turns out that Viacom claims it has been trying to negotiate a "fair" renewal of its prized cable channels for months and months, but reputedly Time Warner Cable has been unresponsive and "unreasonable". The nation's 2nd largest cable system operator, in turn, claims Viacom is asking for "exorbitant" increases in carriage fees which would have to be passed along to the customer. So now this fight between the two Big Media giants will hurt cable viewers. At 12:01 AM on January 1st, just after the ball drops in Time Square, Time Warner Cable's 13 million subscribers will lose 19 Viacom channels. The howling starts here, especially by parents home for the holidays with children who won't have access to their favorite shows like SpongeBob Squarepants and Dora The Explorer, and tweens/teens wanting to see new episodes of those new unreality Reality TV series The City and Bromance, and twentysomethings and older who get their news from The Daily Show With Jon Stewart or The Colbert Report.

This affects all U.S. Time Warner cable subscribers including those in New York and Los Angeles. Alex Dudley, a vice president at Time Warner Cable, the nation's second-largest cable operator, is telling reporters that the dispute with Viacom "is that they have asked for an exorbitant increase in their carriage fees and their network ratings are sagging. Basically we're trying to hold the line for our customer." Time Warner Cable claims Viacom has asked for fee increases of between 22% and 36% per channel, but Sumner Redstone's company maintains the increases would cost less than $.25 a month for the package of channels per subscriber who spend a fifth of total TV time watching Viacom shows but its fees make up less than 2.5% of the Time Warner cable bill. (Sports channels are paid the biggest cable premium). But Time Warner Cable also is complaining that Viacom's popular shows are rerun on Web sites where Viacom collects advertising revenue that it does not share with Time Warner. On the other hand, Viacom has staked much of its revenue-growth prospects on squeezing higher carriage rates out of its cable and satellite affiliates despite an ad slowdown and weaker ratings.

Such negotiation battles between cable networks and cable system operators have happened before and lasted merely hours. In 2004, for example, Viacom's cable channels disappeared from EchoStar's Dish Network for two days while both sides fought over the terms of a new contract. And Time Warner blocked ABC from its cable systems in New York during a breakdown in contract negotiations with parent company Disney. So this one will either end fast or go on forever. It probably will depend on how many subscribers start flooding Time Warner Cable with obscene calls. Viacom has already started a hardball campaign to "Call Time Warner Cable and say 'NO' " starring The Hills and South Park.

This is Viacom's just issued statement:

This move by Time Warner Cable to force such channels as Nickelodeon, Comedy Central and MTV off the air is another example of a cable company overreaching for profit at the expense of its viewers.

The renewal we are seeking is reasonable and modest relative to the profits TWC enjoys from our networks. We have asked for an increase of less than 25 cents per month, per subscriber, which adds up to less than a penny per day for all 19 of MTV Networks’ channels. We make this request because TWC has so greatly undervalued our channels for so long. Americans spend more than 20% of their TV viewing time watching our networks, yet our fees amount to less than 2.5% of what Time Warner generates from their average customer.

Throughout the country, we have negotiated equitable license agreement renewals, or are in the final stages of renewals, with virtually every cable and satellite carrier. Nevertheless, Time Warner Cable has dismissed our efforts at a fair compromise and has effectively chosen to deny its customers some of the most popular TV shows on the air.

As a result, we are sorry to say that for Time Warner Cable customers our networks will go dark as of 12:01 on January 1st, denying Time Warner customers shows like Dora the Explorer, SpongeBob SquarePants, The Daily Show with Jon Stewart, The Colbert Report, and The Hills.

Ultimately, however, if Nickelodeon, Comedy Central, MTV and the rest of our programming is discontinued – over less than a penny per day - we believe viewers will see this behavior by their cable company as outrageous.

Time Warner Cable subscribers who are being handed a January 1st $3 monthly increase in Raleigh, Orange County, Los Angeles, and New York City are simultaneously facing the removal of beloved shows across 19 channels.

We find it a shame that Time Warner Cable remains unreasonable at this time. We hope its leadership will have a change of heart and will seek to negotiate a fair renewal agreement.

    Let's see.....prices creep up almost monthly....they have a long history (specifically with me, and I know of MANY others) of missing appointments and then lying about it so they don't have to give you a month of free service (that's the policy) or admit they screwed up...I've missed many a Saturday waiting for service people who TW will swear are coming up until the minute they don't come, and then they will swear they were there and you weren't home.....billing errors are ridiculously painful to solve....they once made a huge hole in my ceiling, complete with plaster all over the floor and tried to sneak out saying they were finished working without even acknowledging the damage they did.

    I could go on, but i'm tired and I get pissy whenever i think of them

    Yes, whenever I think about my experiences with them I go into a bit of a rage. I did find crying on the phone to a supervisor to be very helpful.
  • Cablevision isn't really any better in any of those respects. But at least I'll have my Comedy Central.

    Just hold out for about 2 more years and FIOS will be here!

  • This might be the perfect time for me to drop the cable. I've watched close to no television since the election, anyway. And if I want to catch Jon Stewart, or anything else on Viacom, I'll find it on-line. Hulu is basically all I need.

    Having said that, I'm thrilled 24 isn't on Viacom. As long as the coming season isn't as horrible as last year's that'll be the one thing on my regular viewing schedule.

  • From Carnivore's stated location, they're in Prospect Heights. As a resident there myself, I can affirm that the Heights is Cablevision Land. However; don't envy us too much: we don't get BBC America, which PISSES ME OFF. C'mon, I need my Brit TV fix!

  • Flexi - I can definitely see why you think they suck. I've had the opposite experience though. In my 9 years of using them, I've only lost service maybe once or twice - and they always fixed it right away. I've been very happy with the service. Maybe I've just been lucky though. I know my parents have Cablevision and they've had experiences identical to what you describe. I think what you're describing can happen with almost any cable company. Come on, don't you remember the Seinfeld episode with the cable guy??

  • I recently cut out my HBO (nothing on) and was attempting to disconnect the landline (triple play thingy) and they offered me a lower package price. Am I locked in for the next 2 years even though they are no longer able to provide me with the services I'm accostomed to having? These are the services I agreed to and now will no longer have them.

    Don't get lolled into thinking you have a land line, you don't if it is through Time Warner. AFAIK TW only offers VOIP telephone. No power, no phone so not the reliability of a landline plain old telephone service.

    You'd have to read the signed contract but chances are their lawyers figured a way around that. Course if you don't have a signed contract.....
  • I didn't sign anything. It was all done over the phone when I called to cancel the HBO.

  • directTV. love love love the dish. cheaper than TW, and even better i don't have to deal with TW. because they suck and they're nasty and impossible to reach and deal with. and i'd like to get through the rest of my life without having to pay them one more penny.

    who provides your internet service? because I did DSL and it sucked hard

    ah, see, I can't/won't go back to DSL as much as I'd love to dump TW in a heartbeat.

    DSL is too slow, and I have 3 laptops, Vonage and a Roku box all depending on fast internet - need it for work and don't have the patience for slowness for leisure

  • I agree about them coming up with an 11th hour deal. If not there always the Internet ;-)

    Re TW - I have had TW for TV and ISP (RoadRunner) for years...and can only remember a couple of times having real problem - and those were solved to my satisfaction. So I don't get the service complaints I read here. Nor do I have surprise billing problems. My bill is always correct and I know when and if it changes ahead of time.

  • Why not try DirecTV and if you're on a budget try DISH. You can get satellite internet service through them as well.

    I, personally, have DirecTV but I use Earthlink for home phone and DSL service which is fabulous!! If I have a problem, (though they're customer service is outsourced to India) I get prompt and courteous help whenever I call and my problem is always resolved in a quick fashion. Time Warner used to be great. Cablevision is the worst thing you can get if you live in Brooklyn. They cheat so many dollars from people who use them. Good Luck and HAPPY NEW YEAR!!

  • You think they would come to terms. So more people would subscribe to their services. Now people are just going to go else where. Staten Island already has Fios! So its 19 channels we wont get. And we still paying too much for nothing on there. I love my TV Land. and NIck/.

    call and complain. If they don't come to a settlement (I suspect they will), I will be doing so...and will also be doing more research on DISH or other options
