that is actually NOT correct; acceptable noise levels in nyc are a certain decibal point above ambient noise. it's not a free-for-all. people seem to think it's a free-for-all because something about living communally makes some people think that they have license to make as much noise as they want. this is not true

Uh, no. That's simply not true. Read Section 24-243 of this link. Daytime ambient noise regulations apply from 7am to 10pm. That's the law.

Agreed. And if you read this thing, there are LOTS of exceptions - the 7am to 10pm is just the general rule (for example you can only operate a lawn mower between 8am and 7pm). -
there seem to be two schools of thought here:
people who decide that living communally means that they can do anything they want, at whatever time they want, and that it's ok.
people who think about how their noise/activities affects those around them and act accordingly. i'm the latter, above me is the former -
I'm not asking people to stop living, just to start being a little more aware and respectful. Not too much to ask, you would think.
Our board is useless. So useless when it comes to this stuff that the board president is a culprit herself when it comes to obnoxious levels of noise at all hours of the day and nite. There is no recourse except to sue and the board already hates everyone anyway so imagine if you sued all of them and they hate you even more! and actually, the board is not the law enforcers when it comes to stuff like this. What I mean is that there's only so much they CAN do, including letters of "threat". Once this is done they wash their hands saying there's nothing more they can do. Yhere's actually a lawsuit against the board prez and now the board will be included so they will finally realize it's time do something.
imagine spending 1000's on buying a home where you think you will have like minds living because of the huge investment to only find out that the like minds are really minds of idiots... -

just me wrote: so the sad part of all of this is that I own. so while i want to move the process is more difficult than you can imagine. even sadder: the board won't do anything, the management company is a freagin' joke and won't get involved, the super sucks and I have no other outlet...
If you own a coop you are a renter and there is an implied warrant of habitability. Renters can withhold rent, or maintenance in a coop but there specific steps you have to take to legally do it. Suggest you pay a lawyer to right a letter to the board. Certainly cheaper than moving. If it is a condo then you might have problems -
brooklynjack, as someone who is in this situation and has done just this... i've been dealing with my noise situation for what is now over 3 years. my attorney has contacted the board attorney, the board president. etc etc.
what it really comes down to is how far do you want to fight it? how much $$ is in your coops' reserve fund, because the $$ in there used to fight against you is your $$ also and the amount can increase/decrease your property value.
i am the most idealistic person that i know, and i have pushed my situation as far as i can go without having to actually sue. but it's been draining and soul-sucking.
i have no answers. -
brooklynpotter I have to agree with everything you are saying. i don't know if we're in the same building...not sure if it would be as funny as I'm thinking it could be! LOL
I have thrown my hands up in frustration and I only bitch on boards or to other unhappy share holders. I snarl at the board members i don't like and just silently nod to the others. I take lots of deep breaths and sighs and go about my day and keep telling myself, the market will shift and I will sell soon enough. but believe me, i am out of here. -
justme, thing is that i really love my apartment. and the thought of moving, even when the market improves, is awful.
but... it's a catch 22 when it's you against the board; board dynamics are like nothing i've ever witnessed in the work force/school, or any friendship/relationship i've ever had. people react viscerally, and they are bullies. it's horrible.
my next apartment is going to be in a HUGE building, where this kind of crap is dealt with by a giant anonymous board. i don't think i even want to know one of my neighbors next time--there is little worse than becoming friendly with one neighbor, then having them totally go after you at a meeting for something you don't agree on. -
In my first post (the original topic) I mention how i love my apartment and my location so I hear you. It makes me sad. The only difference between me and you right now i I WON'T move into another building where I have to ask permission for ANYTHING I want to do to make my life better. I WON'T move in to a big building where I have to be responsible for anyone else but me. I WON'T move into a building where everything that happens is contingent upon a vote, signatures, lawyers agreeing, or someone else saying it's ok to make your life better, you have my approval. F*** THAT. It may sound selfish but I'm a big girl now and tired of this. Phase 2 in my life will take me to a quieter area, less hustle bustle and more polite folks I can call my neighbors.

justme, i moved into an amazing building 6 years ago. great people, tons of respect, no votes just kindness, etc etc. one by one those people moved out and now i am the person living here the longest, surrounded by a bunch of people who hate me. it's fun.

I guess you just get tired of fighting for everything. I think I'm nieve sometimes when I think the basics in life are as simple as I kind respectful gesture to the person that's standing right next to you!

my brother lived in a nightmare building for a while as well; we each had one of the craziest people in park slope living above us.

So you are going to buy your own private island? Even if you buy a private single family house you'll need to get some permissions, you'll still have to live by noise and zoning laws -

No, i don't live in the building next to you (you live near Windsor Terrace, right?). But, I do live in a small co op building where we all do get along rather well, give each other Christmas gifts, take care of each other's pets, etc. etc..
I feel very blessed, we had some terrible people who lived here years ago and made it hell for everyone else, since then, we have been ultra careful in our co op meetings where we meet prospective owners. -
that's the thing: i was at all the meetings where all the wretched people were accepted. and i approved all but one of them--and the one i didn't approve, who i got overruled on, turned out to be the one i dislike the least.

the one thing about the revenge factor that many seem to overlook is that
there will usually be a perfectly innocent neighbor who is now blown out by your noise.
for example - someone complained about "upstairs morning bass music" and "next door grand theft auto" so loud they cant hear tv.
I dont know any of these people, i dont live there, so i include the possibility that grand theft auto guy MIGHT be pissed at upstairs morning bass music too ! so MAYBE thats HIS revenge. and MAYBE upstairs morning bassy music guy is getting revenge over someone elses "extraordinary sexual noises " at odd hours..
(my wife was actually quite proud that we received such a complaint LOL)
and those people are only having sex at 4 am because their neighbors dog only stops barking between 3 am and 5 am.
alls im sayin is that if the revenge thing is really necessary try to not let spill over onto innocent neighbors,
otherwise you become the person youre complaining about. -
My upstairs neighbors are evil, evil people. I suppose it could be worse, but I just think they are horrible. Do I have any rights as a renter? I asked management to call them and they did, but it hasn't gotten better.

Just a tip about dealing with certain kind of psycho neighbors. If you suspect you are dealing with a selfish amoral creep, then telling them what they are doing is annoying you makes them want to do it more to assert their dominance. For example, loud music. Instead, you might try asking them (with a big smile) what they are playing because you'd like to get the cd. Reverse psych. They will probably turn it down just to spite you.
Don't ever try to apply basic logic and civility with someone who has major boundary issues. If they were decent, they would care if they were disturbing you and try to work out a solution without being asked twice. -
