How early can construction work legally start? — Brooklynian

How early can construction work legally start?

Does anyone know if there's a legal limit as to how early construction work can start?

I'm a night-owl by nature - in bed by 3 or 4 am, up by 9 or 10 - and the construction work being done next door has been quite a shock to my system since they're generally starting at 7:30 or earlier.

The work being done is a refurbishing of a building next door that's on a corner, facing Franklin, with the back facing mine so all the windows point to my building, and I can hear everything, even if my windows are closed.

I don't mean to begrudge anyone doing a job or trying to make a living, but 7:30am does seem a bit early to be running a bandsaw, especially since they seem to usually finish up a lot earlier than they need to, i..e by 3 or 4pm.

  • 7am to 6pm is what is allowed without a variance. It's common for construction to start early and end early, just kind of sucks that your schedule goes against that.

They are also supposed to have some noise reduction measures in place if they use loud equipment but that is usually for things like large generators, jackhammers, etc.

So based on what you said it sounds like they aren't doing anything wrong. The best thing to do may be to get some ear plugs or a white noise machine to try and cover up the sound.

Thanks. I just called 311 (what I probably should've done in the first place), and got the same info. For the moment, I guess I'm just going to use my AC as a white-noise machine, but not really sure what to do once it gets to September. Hopefully, by then, they'll have put up some windows, or at least will be done with the (re-)framing and will have moved on to painting the place.
  • Try going to sleep earlier. It's healthier. For every hour of sleep before midnight is worth two every hour after. . . that's my motto.

    Ha, I wish!
  • [SPAMSPAMSPAM link deleted] White noise sounds like rushing air and is perfect for adults, children, and babies who are having trouble sleeping.
  • I could swear sometimes they start before 7am :) or maybe I just need more sleep? I use a couple of [SPAMSPAMSPAM link deleted] white noise machines I've picked up over the years for when I need to induce/ensure a good nights sleep. I've learned to combat neighborhood construction by setting one of my devices to turn on in the morning at 6am, starts the same time as my coffee maker :D
  • Subject: FAN

A loud window fan is an ideal white noise machine. Gonna need one anyway come summer.
