    Dont they have to give the landlord a minimum of 3 months notice?
    Unless he/she was under that time and the landlord jumped the gun with you.
  • yeah, the standard lease says something about 30 days notice.
    It might have been a lame excuse, but who knows...
  • The tenant being required to give proper notice is a rule the landlord has to right to enforce or not enforce. If the landlord decides in the final hour to allow a tenant to renew, its his prerogative. Its much easier to keep an existing tenant than to get an apartment ready for a new one. Regardless, it was a still a completely sucky thing for a landlord to do. At least its a great time of year to get a bargain. Good luck.
  • Yeah, I don't want to burn bridges (much), it was just an exceptional opportunity for an apartment. I was told that the landlord's hands were tied, which I am admittedly skeptical about. I would assume the tenant had a very last minute change of circumstances and begged to renew, and the landlord relented. Things happen and I might do the same if I were either of the other two parties. There's certainly no legal recourse here and it's not worth getting into an ugly fight and pushing someone out of a place even if there were.

    It would sting a little bit less if I hadn't met them and had a very pleasant conversation about the apartment.

    one of my tenants didn't renew for like almost a year :p. I gave them a new lease. they said they'll do month to month and almost a year later.

    they came to me and change the dates of the lease and told me if they could do that. i'm like sure :p.
  • Hey Count.. I like your attitude. Sure it was a disappointment but gotta keep perspective on this kind of thing.

  • Unfortunately, some leases can have a clause indicating the tenant and LL agree to renew the lease at "fair market value". That "value" can be determined by arbitration, experts assembled by each party or on the cheap, i.e. advertising and leading a virgin tenant, with his wallet open, down the garden path. I wouldn't be surprised to learn that the tenant, in hand was listening in to or viewing phone/emails indicating that the new tenant accepted terms on the apartment.
  • Well, it was rent-stabilized and well under the market price (sigh), I don't think anybody was negotiating anything. And I was told why the tenant was leaving in the first place, which was certainly not cost-related. But who knows. Anyway it's too depressing to think about. :)
