    In our building we had a couple celebrate the 4th with a rooftop shag, in sight of another unit's deck. Stern warning issued by Board of Managers that public sex not allowed. Not sure it's in the by-laws, though.

    usually on a balcony, there's a higher percentage chance of getting caught
    by your neighbor{as examplified by the curbed.com link} which heightens the danger level

    whichever neighbor catches you on the balcony {"oh hi mr martin. oh no. we're just fine. please go inside. sorry :oops: "}
    it's more than just a stranger who you're probably never gonna see again

    And in this case, there were a bunch of other balconies, since it was a hotel that was also being used as a dorm. Ah, youth. If there were voyeurs about, they were very quiet. A roof it wasn't, but public it was. That's probably a different poll.
