Iron railing with gate looks movable and a legal Vehicle as defined:Vehicle. Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
You could fit several motorcycles in there.
The original approval of the garage in 1925 by default gave the owner a legal driveway. Which, I think, he has been careful not to compromise.
(2) Driveways. In front of a public or private driveway, except that it shall be
permissible for the owner, lessor or lessee of the lot accessed by a private
driveway to park a passenger vehicle registered to him/her at that address in
front of such driveway, provided that such lot does not contain more than two
dwelling units and further provided that such parking does not violate any other
provision of the Vehicle and Traffic Law or local law or rule concerning the
parking, stopping or standing of motor vehicles. The prohibition herein shall
not apply to driveways that have been rendered unusable due to the
presence of a building or other fixed obstruction and, therefore, are not
being used as defined in section 4-01(b) of these rules. -

It's called reasonable doubt. The very basis of our legal system.

maybe, but if you get a ticket; parking violations usually considers you

Just because somebody asked...http://www.shomer-tec.com/product/special-ingredients-liquid-keyscratch-328.cfm -
So: not wanting to break any laws, I'm not going to key the guy's car or spray acid on the paint. And not owning a Vespa or Mini, I'm powerless to box him in.
BUT, I've noticed that he has a disabled parking tag on his car, which is odd both because his parking maneuvers require that he jump back and forth from one to the other (typically a handful of times) in short order, and because he shoveled his cars out last week; in general he seems to be in very good health.
So in the hopes of some more legally-grounded action, how does one go about reporting someone with a bogus disabled tag? -
disabled parking tags do not always mean that *he* is disabled. it could mean who relies on him to drive them--his child or wife or mom is disabled--and he has to drive them places. and those people may not live with him. does he lives alone?

This is true, but according to the NY DMV brochure, the disabled person must be in the vehicle:
From:
It is a serious misuse of license plates and permits for the disabled when someone other that the person with a disability uses the plates or permit to park in a space reserved for people with disabilities. These license plates or parking permits are valid only when the person with a disability who received the plates or permit is driving the vehicle or is a passenger in it.

It doesn't sound like he's using this pass to park in a spot for disabled in this case, but, if you're so inclined, perhaps you might catch him cheating elsewhere. Not sure where one might report this, but 311 would probably be able to answer that question. -
In NYC it is extremely rare to find street handicapped parking. It's only used in parking lots, so that tactic won't help. I still say beat him to the spot on ASS days.

it could also mean the permits were purchased illegally, as has long been suspected by advocates for the disabled.
...there was some recent press around the issue. The "news" didn't go so far as to actually accuse theft, it just said "greater accounting was needed".
(one could read this as "NYC, clean up your act or we will attempt to pursue this further")

the blue tags you hang from a rearview mirror are ubiquitous.
The NYC Parking Permit for People with Disabilities is much more difficult to get. I seem to vaguely recall a few years ago hearing that there are only about 20k of those in the 5 boroughs. -
Whhooooa, hey, holdonnaminute!
What makes us think that a guy who happens to have a highly evolved system for screwing his neighbors out of a public parking spot (to make his own parking easier).. would try to game the handicapped parking system (to make his own parking easier)? -
I know shocking stuff. ...but those who love their cars have been known to go to pretty extreme lengths to have them close to them.
I'm not discussing this particular driver/parker, of course. -
Sound like he needs to be boxed in not with Vespas or Smartcars, but an electric wheelchair. Sure, he might push it out of the way with his monster truck, but video of the guy ramming a wheelchair while flying the handicapped flag would be priceless in your campaign against parking abusers!
And then Carnivore could put the wheelchair back together with his gap filling glue. Everyone gets a chance to play. -

This is true, but handicap parking permits also allow you to park anywhere where there is a no parking sign (no standing is still restricted). So any church or school area during the daytime is fair gameWhere can I park with it?
Source:
This permit allows the driver to park at most curbsides on City streets including:
In all No Parking zones except those marked as taxi stands; "No Parking" or "No Standing" spaces authorized for doctors, press, diplomats and government agencies; at parking meters without depositing a coin; in "No Standing, Trucks Loading and Unloading" zones except for specified restricted hours.

I didn't read that page closely enough; as far as I can tell, only the NYC parking permit ("rectangular placard") lets you do that, not the NYS one ("hangtag")

If I lived on that block, I would be calling 311 like every 20 minutes.

as much as this is irritating, I dont think he's doing anything illegal. If it really bothers someone, they should camp out around alternate side parking time and swoop in there before he has a chance to move back. Thats legal and doesn't involve vandalism which is not only against the law, but also extremely petty.

The irony of it is, if one of us swoops in, I'll bet good money this anal blister of a citizen won't hesitate to take some of the steps we revenge fantasy weaklings only huff and puff about.

SSS, I totally agree with you!

oh goodness... i hate parking hogs -_-; if i'm in a particularly bad mood.. ijust leave them a not-so-nice note..
