Insurance question — Brooklynian

Insurance question

Does anybody know about a NYS law that allows/requires health insurance companies to keep adult non working children (yes, still living at home) on a family policy? Up to what age? Thanks.

  • Let me qualify that. Is it possible that there is a loophole for union generated policies that allow them not to include adult children?
  • I'm not exactly clear about union generated policies, but I know that if said child is living at home but going to school (college), they can still be covered by insurance.
  • A friend just put her son on her plan since his union opted NOT to provide health insurance. She was advised by her carrier that the kids do not even have to be attending school and are eligible to remain on the parent's plan up to AGE 30!! Of course there are additional premiums. Here is the recent NY law:
2009 AB 9038 allows an unmarried child to remain on parent's insurance up to age 30 if they are a resident of New York. Site: www.ncsl.org

A whole NEW reason not to leave the nest!!!!!
  • Thanks Domino, I've downloaded the entire bill to read regarding Union generated plans. Do not see any reference yet though. Thanks.
Yes, the nest thing. Hmmm, maybe I won't say anything.
  • A whole new reason to pack the kid off on an exchange program to one of the other 29 OECD nations, all of which provide excellent free/cheap universal health coverage (not including Mexico).
  • There may very well be an exception for union plans - for example, I thought if an entity employed more than a certain number of people, that entity was required to provide health insurance options. Apparently, unions members can vote to opt out of this requirement!

There is a hunger strike in FL currently regarding the maintenance/cleaning union against Disney. Apparently, Disney wants the workers to be on the company health plan (which requires employee contributions) and the workers want to stay with the union plan which does not require any contributions.
