I am always curious about this -- public schools seem to do it a lot, but it's clearly against copy right laws .... right?
-
Looks that way to me. It's a public performance. Maybe one of the parents works for the movie studio and got an official copy of the film, but even so I doubt the studio would authorize a public performance. I'm guessing it's a bootleg copy and that the showing is completely unauthorized.
-
Actually the movie is out on DVD for purchase so I am sure it's not bootleg. As far as copyright I don't see a difference between this and say inviting people over to watch a DVD in my home.
-
actually, big difference - copyright 101 stuff. you need to obtain public performance rights to charge for a public screening... quick google found the rules outlined on a college website (tho it's federal law - I just don't have the moments to source it right now..)
-
[video]From www.copyright.gov:
§ 106. Exclusive rights in copyrighted works
Subject to sections 107 through 122, the owner of copyright under this title has the exclusive rights to do and to authorize any of the following:
(4) in the case of ... motion pictures and other audiovisual works, to perform the copyrighted work publicly;
-
Actually the PS9 PTO paid for a years license so we are all legit.
-
As a teacher we get notices from the chancellor a lot reminding us that we can't do plays, etc. without purchasing the copyrights to it. (this probably applies to jr high/high school more, but yeah) and I would assume movies are the same. Whether you bought it or you bootlegged it, I doubt you can charge people to watch it...It's for personal use only. The only exception I've been able to find is if it's used in a direct classroom (meaning it's understood to be limited to under 40 people) and is for educational purposes only.

Hope you have a great turnout!

Maybe they can get away with charging for it under the guise of it being a "donation".I predict the school looks the other way because it is hosted by the PTO, not the school itself (yes, this is often a matter of splitting hairs).
But, I agree, if you advertise something on the web, it is pretty hard to convince people that this a "private performance" .
I also suspect that the copyright laws are tapered by the bad press Disney would get if it went after a public elementary school.

xlizellx and whynot, as I metioned above, WE HAVE A LICENSE!!!!!! Which we paid good money for, so back off, just be happy for us.
Thanks Stacey!

Does having a lic allow you to charge for showing it in a public performance, or just to show it publicly?
Are there different grades of lic's?

I must have missed that above......?
That said, I am happy for you - just curious! Kids love this sort of thing and it always makes money for our school.
I teach elementary school too and we do the same thing as a fundraiser with our PTA, I just was curious why this was permitted/ignored is all. -
Wow, really people?
Nplop, good luck on the screening, a measly $5 basically covers what you pay for a bag a popcorn at a theatre anyways. So I don't see what the argument is here. But anyways, thanks for posting.
-
pnlop - we posted at the same time.
-
xlizellx no hurt feelings don't worry : )
Whynot, since you are so interested, yes there are different types of licensing deals, and the one we paid for is the one we need in order to do our movie nights. We are requesting donations not because of the licensing clause but because it's a school thing.
-
I think everyone liked the idea of the fundraiser, and then decided to jabber about copyright law out of curiosity.
pnlop - thanks, good luck on your fundraiser.

WhyNot, please speak English!
wether is different grades of lics
