ALERT!!! Bum sleeping in TD Bank ATM area. He must go!
Park Slope residents we need your help. It appears that we have a homeless man setting up shop after midnight in the ATM area of TD bank (1st Street and 5th ave)on a nightly basis. He is obviously seeking the cool air of the air conditioned foyer but in the process he is stinking up the place and making money transactions unbearable. I have called the police numerous times but as soon as they eject him and leave he returns to the location to set up shop. It has gotten so bad that now they refuse to respond. Why are the police in this town so useless? I need the help of my fellow residents so we can bombard the 311 system with calls. If enough people call they will have no choice but to address the homeless condition at the bank. The squeaky wheel gets the oil and so I ask my fellow residents to make as much noise as possible.

Here's the smart thing to do. Take photos of this guy, show the bank manager, tell him/her that he's creating a nuisance and possible safety hazard and let them deal with it. I don't know why people insist on calling 311. They're an information line, not a crime stopping or alarm stopping number. By the way, I would think he's got some kind of ATM card in order to get in. Maybe he's a customer and he's tired of waiting on line so he wants to be the first to get into the bank in the morning.

Let it be noted that I have not responded to any post of Vincelnthebay because I find his 20 postings... offensive and against the spirit of this site. Of course that is just IMO and I do not give it based on validation of "older" posters, more frequent posters or whatever but felt the need to just put it out there.

Are there any L&T lawyers looking at this thread? Hypothetically, can a transient declare squatting rights if said transient occupies the space for a certain amount of time, without being asked to leave? Granted it's a business space.

I am sure one need not ask a lawyer about finding out if a bum has squatter rights to an establishment that is not abandoned. This bum is actually on private property and should be treated to the fullest extent of the law. If it were left up to me he would be tarred and feathered as a lesson to all hobo's who would defile private property.
Let me thank the two officers that responded last night to my calls about the hobo residing within the TD Bank ATM vestibule. Last night I changed tactics and decided to call 911 instead of 311. I called stating that the hobo within the TD Bank establishment was exposing himself. Shockingly the police responded quite quickly and they ejected the individual in due haste. They were very stern with the bum and instructed him to go sleep in the nearby park instead. These officers surprised me by remaining an extra 20 minutes in order to make sure that the hobo did not set up shop again.
Kudos to the responding police man and police woman. For once I am applauding them instead of bashing them. Job well done, guys.

However, a debate rages about how to best protect enjoyment of public spaces.

As you are likely aware, lots of laws have been passed regarding loitering, when the parks close, whether you can rummage though the trash or panhandle etc.
Cities all over the country and world struggle with the issue. The commenters on the above link seem pretty thoughtful about the issue. There is no easy answer.

Degenerates such as this ATM squatter should be removed from society immediately. Why should he be allowed to declare squatter rights anywhere he lays his filthy head? Why can't he find a job instead or go to a homeless shelter? Why must this transient be allowed to set up home in an ATM vestibule in our neighborhood? I am 100% sure he pays no taxes and we know for a fact that he only contributes pestilance and lice to our community. He must go somewhere else before our property values drop even lower.
