I have a simple (?) question regarding "exclusive use" clauses in condos but im not even sure where to start.

We own our apt (condo) and have exclusive use of our yard. the condo actually owns all the yards. BUT we want to see if it is possible to buy the exclusive use rights for our neighbors yard.

I realize that if its legal/possible we would have to have the bi-laws and the offering plan amended and it would require a ton of lawyer stuff (technical term). I just dont even know, from the get-go if its legal.

anyone have any clue about this stuff?

  • I fall under the category of "anyone".

    I would imagine this would take the form of a time limited lease. This way, the owner and your group could separate if things went sour, or they decided to use the property themselves.

    It would also keep the property taxes in the current owners name, and might allow you to avoid spending a large amount money up front.

    ....Or mess with the bilaws.
