Landmark Pub knows that people say disparaging things about it behind its back. "Its better days are behind it." "That place is a wreck." "The owner's crazy."

Now Landmark Pub is wreaking a terrible revenge.

    I'm confused; why would she sue the city and not the owner? Surely the owner is liable for the damage done to her car.

    Too bad the article had the wrong street address.
    187 7th Ave aka 495 2nd Street is the location for the Building in question.
    The Dept. of Buildings website is a goldmine for the building's violations.
    ... one reason why the woman is suing the city. the city is responsible for building safety ... the city sure knew about the problems ... and has much deeper pockets than the building owner, who will probably cry insanity or something similar.

    Although someone could have DIED from that--why the hell must you sue the city?!! What is her point exactly...sue your way towards preservation or prosperity?

    I have mixed feelings about this. On the one hand, it kind of seems as absurd as trying to sue the NYPD if you've been mugged. Too, I despise litigious culture. On the other hand, this particular mugger has been in one spot, rotting away for the better part of twenty years. Obviously, there have been complaints to DHCR or whoever, and the condition of the building is plain to see. That shit should be condemned.

    I figure if the plaintiff is looking for the cost of her roof back, plus reasonable damages and fees, ok. But yeah, this shouldn't be any $10m get-rich-quick lawsuit.

    it is one thing if she wants to sue the city to recover the cost of fixing her car. My guess is that she will add on "pain and suffering" and try to collect millions. Its too bad.

    Don't worry, no one is getting millions for pain & suffering. There is no money to be collected here except for the damage to the car. Also, the city will add the building owner as a co-defendant, if she's not already named in the lawsuit. The lawsuit is useful if it gets someone in the government to pay attention to this building and take appropriate action before someone is injured.

    Guess I just don't understand these things. Ever. That crazy lady and her daughters ought to pay--and even if it's excessive; so is their selling price.

    Yeah, eventhough it may be harder to prove that the city is jointly or severally liable in this case, it will be more likely that she will collect from the city if she wins. Sadly, even if you win a civil suit, it can be pretty damn hard to collect the money you won. You always see those news stories about contractors who don't finish a job, are ordered by the court to pay back money, and then just never pay the court settlement. I haven't been involved in a civil suit, but I can't even imagine the pain in the ass it must be to collect.

    It is. I've been in that situation and I am still waiting...three years later....Short of getting the US Marshals after this miscreant, there's nothing to be done.
