Ccan anyone suggest a lawyer? Preferably a mean one?
As Pogo would say " Haaaaallpp !" . I have had ten years of harrassment and bad AND illegal behavior by the only other member of my coop beside myself and I need a lawyer. Yesterday. A combination of piranha, shark and pitbull with a little vulture mixed would be the minimum needed to deal with this woman. A few highlights: moving coop money from our bank to another without consulting me, refusing to cut a coop check to reimburse me for money I fronted to change the brownstone's main entrance when I was held up at gunpoint , refusing me access to the coop files or checkbook, mendacious barking dog reports filed with the DEP, verbal harrassment of me, roommates, my sister, attempted harrassment of my parents who are IN THEIR EIGHTIES, a habit of ordering me to do things, for instance; move an exercise bycicle which was a floor below her and on carpeting and used twenty minutes a day, ohh, it goes on. And she has taken full advantage of the fact that someone who has been sick for over twelve years is not going to be able to fight her every day. Most of my money goes to doctor bills but for someone who could make this lunatic harpy behave, I'd FIND the cash.
If anyone has good information ...you'd be doing a mitzvah. A big one. Thank-you!

My guess is your attorney's first piece of advice will be to stop posting about the matter in public forums.

Subject: Seriously, are you nuts?
Wow. Here's hoping that completely gratuitous bitchery is not the only response I get. Tell me, do you offer pointlessly hostile responses to everyone in this forum who is looking for a lawyer...and there have been others I've seen here, or did I get the special delivery? No wait, I don't care!
And for the record I do have a number of friends who are big old lawyers but who do not practice in N.Y. and when I passed the idea of asking my neighbors for lawyer suggestions they wholeheartedly approved. So please, go be nasty to someone else, ok? JESUS. -
Is this correct you live in a ccop with 2 shareholders, you are one of them? Which one of you has more shares? Who is the treasurer? You could go to small claims court for reimbursement.
-
Small claims only covers $3000. And good luck actually getting the money should you win a case. I know from experience.

I sent you a PM.

That's something you might expect when you unload in the wee hours of the morning -- and btw, that poster did not give you bad advice.

http://www.tenant.net/ is a great place for housing info in NYC -- including legal resources -

Seriously, there was nothing nasty in my reply. Posting a request like "I'm having trouble with my co-op and need a real estate lawyer - any advice?" is one thing, but posting a lengthy, potentially-libelous diatribe about a matter that might end up in litigation is reckless.

Good luck. -

Agreed. Two more sentences out of you, and the other coop member might sue you for slander. -
Miss Benson.. I have to agree that though we may feel anonymous on this forum the reality of posting with the vitriolic details you gave is not such a good idea.

To the folks who PM'ed me helpful names and numbers regarding finding a lawyer to deal with my ghastly fellow coop member : Thank you! Thanks so much! And to the folks who feel I should listen to their gloomy and as it turns out incorrect or not pertinent legal advice? With regard to slander and so forth?
As opposed to friends who are actual lawyers but can't represent me here in NYC? Look, you are mistaken.
If your comments were meant to be helpful and friendly definitely yay, though in one case they were most emphatically not; and denying the tone one uses does not magically retroactively change it!
And what the hell? I should be penalized because I have insomnia and posted at some ungodly hour? Hanh?
As far as my post is concerned I wrote all that I did for the SOLE purpose of making it perfectly clear how urgent the matter is, and as far as slander is concerned I said my neighbor behaved badly and illegally, not that she was stupid. In fact she's very bright and would never be such a cretin as to pile the irritation of a frivolous action for slander on top of everything she has done; which can be amply documented and WILL put her tush in the hot seat in court or at the negotiating table. As soon as I find a piranha-like attorney that is.
For the suggestion of small claims court I'm afraid this is waaay too complex a matter for them to deal with...which is probably a good thing since a victory in small claims means you see your money in about a thousand years if that. Been there. With regard to the link to that tenant thing, I'm not a tenant, I'm an owner so that wouldn't work, but thanks. And to answer the other query we are absolute equals in the eyes of the law in terms of shares and so forth.
Thank you folks again for your good luck wishes, I am crossing my fingers that at least ONE of the lawyers I speak to tomorrow has fangs a foot long that drip hydrochloric acid. Something like that. Heh. Wouldn't it be exotic to see the shat-upon win for once? I think so.
Be well. -

heh - then you won't mind me calling you a "lunatic harpy" then.... -
I'm relatively new to this board, so maybe there's something I don't know, but... I kind of don't get why everyone is jumping all over this woman? What exactly is she doing wrong? I mean, yeah, her post was kind of rant-y, but I see rants on here all the time. She just sounds kind of desperate to me, and was asking for help finding a lawyer with a certain temperment.
I mean, "lunatic harpy"? For someone you know nothing about and have never met? Jeez... -
I'm guessing the "lunatic harpy" comment is in reference to her own use of that term to describe her adversary.
I sympathize with her situation - I just hope her rant doesn't come back to bite her. I've heard of public comments such as this introduced in mediation proceedings.
And I agree that there are far too many "rants on here all the time" -

Dudette, I was TRYING to be helpful.

You can get into trouble if you slander people, even online. You have not, to my understanding, mentioned a specific person, so you're not there yet, but from the overly-detailed direction you were going in, it seems that you were getting close.
If some jerk is harming you, I hope you get your justice. -

People say bad things about others including neighbors, businesses and business owners on this forum all the time. -
I have won in small claims court twice, and gotten my money within 2 weeks, both times. If I was not paid, my opponent would have had a lien put on his building, or some other punishment. The days of small claims court meaning nothing are over, apparently. And good luck to you, Miss Benson, it pays to stand up for yourself. Hang in there. Hope you find a great lawyer.
-
Be careful of "piranha lawyers". Sometimes they will take a bite out of you as well. Speaking from experience just because one talks a tough game doesn't mean one knows how to walk a tough game. Look for a lawyer who will explain what he/she is doing, why and what he/she hopes to accomplish. You should also look at the track record. Otherwise you're spending money on a empty suit.

Actually if you live in a coop you are a tenant. You own shares in the corporation and have a proprietary lease.MissBenson wrote: And to answer the other query we are absolute equals in the eyes of the law in terms of shares and so forth.
In the end a coop can evict a shareholder tenant but as you have equal shares getting the votes to do that is tuff. If it were me I'd strongly consider selling my shares and moving, and to a coop that has at least 80 units.
