hello,

my boyfriend and i rented an apt on skillman street. we spoke to the landlord and building manager several times about returning our deposit of almost 1500 dollars. the last time was about 3 weeks ago, and they said they had sent it out. no surprise, the money never came, and two out of three of their numbers has been disconnected. one of them just goes straight to voicemail. it's been about 3 months now and we're ready to take it to the next level. any advice on this? we've never had to do this before, and i guess we're looking at small claims court. any advice would be appreciated. thanks!

  • See that is why people just don't pay the last month's sent! That practice is illegal but Landlords have you by the shorthairs after you move out because they are holding you security deposit. Unless you can contact the former Landlord and get the money you can go the Small Claims route but even when you get the judgement against them if they really want to remain invisible it will be hard to collect that money.

  • DUH that is why many landlords will charge you 1st, last, and security deposit for move in nbow, due to people skipping out on last months with holes in the walls.

    Fairly straight forward. Keep all documentation etc.

  • Small claims court is a joke. Our landlord appear with every lie in the book and should picture of construction work that they were doing AFTER we left in a unfinished state, every thing was an obvious lie and they still won.
    In this city as a renter you have absolutley no rights. The landlord does have you by the short hairs. Also if you sue, whether you win or loose, you can get blackballed by every landlord in the city and not be able to get a rental again.

    Dude. Don't move. NYC is one of the most pro-tenant places in the country. If not _the_ most.

    This is total bullshit. And also possibly true, but I thought you had to go through the renters court or arbitration thingy for that to kick in, or can they also find it through the small claims side?

    You have obviously never been to Tenant Court.
