Fleming Banquet Halls Liquor License is being held up.
The 77th Precinct is holding up the Fleming Banquet Halls Liquor License because there were a so called shooting on the block. If the shooting took place in the establishment I would have understood, but there weren't any shooting at all. This is just a reason the push certain people out of their neighborhoods. I spoke to people in the Neighborhood and they told me that there were no such shootings. I'm reaching out to this Forum as an Iraqi Vet that served his country for 8 years, and a member of the oldest Fraternity know to man.
I've invested my hard earned money into this place. All I want to do is feed my family and myself.
The community Board already approved my request for this license, but they won't go against the police department. I asking for help in obtaining this license. I feel I'm being targeted because of my skin color and age.
This is not fair.

The Fleming Banquet Hall used to be the Sterling Banquet Hall located on Sterling Pl. I took it over. It already had a liquor license on the premise.

If you're talking about Sterling plc between Rogers and Bedford, that place used to be a strip joint. Also there were 2 shootings on that block earlier this year that stemmed from an illegal social club. As for your allegations of Racism, there is no box on your liquor license application that indicates your age, nor ethnic background. Every issue in this world does not neccesarily stem from Racism.

I am talking about Sterling Place between Rogers and Bedford. That place has never been a strip joint. Did you witness the shootings. I heard they did this to someone else. The police department made up some bogus shootings in the area that this person was going to open up their establishment. Do you even live in the neighborhood. I grewup across the street from the place. My mother still lives in the area. This place was never a strip joint. As for as age and race I never said the SLA denied me. I said the police department did. I had to attend the community board meeting for them to aprove me right. So that means they saw me, right. Someone saw me. Many people and myself knows whats going on in this neighborhood and many others like it. Raise the rent, the taxes so the poor can't afford to pay their rent and let other people move in that's not even from New York. They say your lazy so you join the military not to fight for you country, because if you don't you'll end up dead or in jail. Well they also say you should go to college, But your parents are struggling to pay the rent and buy food to feed you and themselves. Then they say get a trade, but you need to know someone to get in. And we all know being a minority the pickings are slim. I want to live just like the jerks that make up these foolish rules. I want my kids to play in a backyard, not on the street corner. Why do we have to get the short end of the stick? All I want to do is do something I love. -

Anything is possible my fine feathered friend, I never said they staged anything. From what people in the neighborhood told me, there were no shootings. So, Instead of focusing on me lets talk about the other issues I wrote about. -

I appreciate you commenting on this subject. Because we all know that when we voice our opinion it's a problem. You see it here very clearly. The fellow that responded to my comment didn't even bring up the other issues. It's time to stand up and shut these con artists down. Taking away people freedom of speech. Destroying people lives. I remember seeing some sweet and gentle ladies wearing churchgoing finery coming out of a place and asking them is it a restaurant and they said it was a banquet hall. This was a few years ago; memory is weak this morning. Perhaps next to a shop that sells both phone cards and haircuts?
Seriously though, how can a shooting in the area make a restaurant ineligible for a liquor license? There are -- what are the stats? -- like a thousand murders a year in this city. The whole town would be dry if that were a prerequisite. -

That is the location. There are bars on Franklin Ave. with liquor licenses. How is that possible? Bars on Nostrand Ave. with liquor licenses. This block is quite. I fought for my country for 8 yrs. Left my wife and kids and went to war. And I have to come home to this crap. An honest man trying to do the right thing. I don't go away at all. I am here to stay. Trust me on that. -
Who is actually in charge of approving or denying the license? And has said license officially been denied yet?

The community board has to approve you operating in the area. There was already a license on the premises. So I don't understand what the problem is... Not officially denied. But there giving me a difficult time. -

First off, thank you for your service.
OK, so it sounds like they are giving you a hard time because the police said there was a shooting on the block, correct? And you claim to have spoken to people on the block who contend that there was in fact no shooting. I would recommend encouraging some of those people to speak to the board in support of your establishment. Or, you could circulate a statement or petition in support of your establishment to the people on the block. I would hope that hearing from these people would influence the community board favorably.
Keep a level head, and try to make a plan here and work it. If things are truly as you say they are, then a clear head and a little legwork should go a long ways towards clearing everything up. -
Isn't it a matter of public record whether or not there were shootings on the block? This should be fairly easy to establish. If the police are citing shootings as a reason to deny the license and you actually think they're making it up, ask for the proof. They should have police reports on the shootings if they in fact occurred.

Thanks for your advice as well. I have left messages with the 77th. I would like to speak to the commander of the 77th. I tried yesterday and I'm still waiting. -
I think you can get crime stats on the internet, one of the nyc.gov sites, I think. If you are going to meet with anyone, it would help you to have the info on hand.

You can, but I don't think that you can get it broken down block by block. -

I've googled my block, which is how I found out the FBI caught an international fugitive right outside my building a year and a half ago.
If you don't find anything by this method, it doesn't mean that crimes didn't happen on that block, but anything major might pop up and that would prove the police weren't making it up.
So try googling the address of your establishment and see what happens. -

More than half the crime that take place in certain neighborhoods aren't reported. It's when the media runs out of stories about paris hilton, lindsay lohan or some foolish rapper doing sometime dumb that's when you hear or read about something that happened locally.

Dumb Lindsay-chasing media slob chiming in here (she's in rehab now, so I've got to have something to do!):
All community boards can do is issue an unfavorable recommendation on a liquor license. The State Liquor Authority is supposed to take that recommendation into consideration when deciding whether to award a license, but as I understand, it often disregards them. I have no idea how successful the local community board has been with the SLA, though.

Community Boards are key, as far as I know, in establishing liquor licenses. If you have the support of your community board, you're good as gold. I can't imagine what else might be holding you up. Crime on the block, unless it's directly related to the establishment, shouldn't matter.
Maybe you're just lacking in info. regarding whose palms need to be greased? I don't know. I've always heard that liquor licenses were a straight forward kind of a thing. But then, now that I think about it, I know some folks who opened a restaurant in the Stuy at a location that had once had a liquor license, and they haven't got one yet. They were sure it came with the lease, only it didn't. And the fact that the place had had one before without felonious incidents didn't seem to matter.
for what it's worth, and that's not a lot, i wouldn't take it personally.
maybe you should get a petition going? If people in the area really want a place to go, that could be the best route.

I'm a little late to the party, but let me get this straight - the OP is feeling singled-out because his application for a liquor license hasn't breezed through? Are you kidding? Have you spoken with other business owners about the travails of getting a license? You're not special - no one is making a dedicated effort to deny you. Buck up and do what you've gotta do.
