Unreasonable landlord?

My fiance has an apartment in Park Slope. After we get married, we are moving at the beginning of December. Because we are getting married the weekend before and my fiance is finishing her last week of school and cannot miss a day of class, we have to move her out of the apartment on Saturday December 1st and cannot move out on Friday, November 30th like her landlord would like. She's been a wonderful tenant for over two years and has kindly given her landlord 60 days notice. The landlord is demanding that we pay a half months rent through December 15th because we need the 1st to move out. I know our situation is not ideal, but demanding a half months expensive Slope rent for 24 hours seems very unreasonable. Can he do this to us? Any advise? Are we just in a tough situation that's not in our favor and have to face the facts, or are we being taken advantage of?

    We just went through this too, not in PS, and paid til the 15th. It worked fine because we just kept using the apartment until them, slowly moving some things, and were finally "out" on about the 10th.

    Can the landlord pro-rate 1 day rather than making you pay til the 15th? Is he ok with you moving on a Saturday?

    Unfortunately, we have to move out of the city that same weekend, so we really are talking about being asked to pay a half month's rent for an extra 24 hours. We've asked for a prorate, even for the weekend, but the landlord won't give us the option (or is acting like he can't and there's no other way but to pay through the 15th).

    He should pro-rate it for a day... I wouldn't pay until the 15th.

    He's not going to evict you- no time for that and you have rights as well.

    he's being a dick.....but to find out if he's within his rights, check out tenant.net. Those folks are pretty well-versed in the laws

    The LL is being unreasonable. At worst he should prorate the 1 day.

    Is he threatening to change the locks tonight??

    Is there a lease?

    I doubt that you have any recourse beyond what is explicitly stated in the lease agreement. If there is no lease agreement then you probably have a strong case.

    If no compromise can be found, I would suggest hiring one of the most reputable moving companies to pack up your belongings and load up the truck on Nov 30. Your fiance would not need to be present. They can then unload the truck on the morning of Dec 1 to your new apartment. Overall, it may cost much less than 15 days of rent.
