Franklin Park Bar... Closing?

I was buying some beer at Fisher's today and a property manager from the area was talking to Tony about Franklin Park receiving an Order to Vacate. He didn't know the specifics, but he was going to walk down there and figure it out.

My first thought was to jump on the boards here. Does anybody know anything about this? Where the hell will I imbibe publicly in my neighborhood?

  • I'd be suprised if this were true. Sounds like a rumor to me.
  • I don't know if them doing well has anything to do with getting an Order to Vacate the premises.
  • Could they have maybe been talking about the burger joint connected to FP? This was just being discussed in another thread recently. I guess the guys received an order to vacate (or something similar) for that place. Maybe try searching here for "Dutch Boy Burgers."
  • There are notices up on the doors of both the big bar at franklin park and the burger place. I don't remember the wording exactly, but it's something about it being dangerous and immediately perilous to life. There's a more detailed note up (or there was last night) at FP, about there being no certificate of occupancy, and the place needing an inspection by the department of buildings.
  • Okay, so the DOB website has this complaint notice for the dutch boy burger address, which says "EATING & DRINKING ESTABLISHMENT UNDER APPL. #310295052 AT 1ST FLR ILLEGALLY OCCUPIED W/OC OF O AND PA VACATE ISSUED"

    It also says RESOLVED but that might just be in reference to the order to vacate that's been served.
  • The small bar is open, but the big room is temporarily closed, so I had to move tonight's FP Reading Series to Soda (629 Vanderbilt, between Prospect and St. Marks).
  • I ran into Tolly at Cornelius today and got the direct scoop. There was a mixup with the permits they have. As I understand it, when the FDNY inspector came, they now want to consider both the new burger place and the original bar annex as the same "space", which now accommodates more people than their original permit (for the bar space only) allowed for. This will hopefully all be straightened out within the next few days or so, but alas, no burgers today.

    No idea, but Tolly made the whole thing seem like a major inconvenience, but probably not more than that when I spoke to him today.
  • It appears that FP has made two applications for C of Os over the the past several years, neither of which has resulted in the issuance of an actual C of O. Without a C of O no Place of Assembly permit would be issued, therefore the current problem with the FDNY which reissues the PA yearly. There's a partial vacate order for the property:

    Probably not affecting the residential part other than using their door for taping the order to.
    It's complicated. It was an Alt. 1 building permit issued in 2007 changing the garage to an eating and drinking establishment which would of required a building without a C of O to at least get a partial one for the first floor. If they didn't get a sign off on the work the PA would not of been initially granted by the DOB therefore causing the FDNY to come down heavy and swiftly.
  • @modsquad: If that's the case, I'm surprised they lasted this long without the proper paperwork in order. This city is a mess of paperwork.
  • I live in this building and was pretty horrified to come home to the notice on my door. I immediately emailed my landlord and he assured me with the same information that Tony seems to be giving out -- making it seem like it's all just bureaucratic mess and it will be cleared up in about a week.

    Still, unnerving.

  • Silly Toly listened to his architect. Now the DoB. and then the FDNY.Burgers by June will be great. Blocked off walls? How many CFM are all your fans?How do we get 275 red meat filled drunks to safety in an EVAC? Common space common fans. Exit plan? When a fire starts in an apt building on or near your 3 spots does it inform the party goers? Hire people that don't know the code and learn the other 10 city agencies .A couple of emails from victims of Mass. night club burn deaths about heavy metal fans dead and toasted will get all the proud beaurocrats to look at this multi street change of use project for what it is...a tiny bit more than they are used to and way more than the area can handle. We all welcome good burgers, serving them only to drunks looks like a problem.Zaytoons,Jamrock,Maya,Chavellas,Ginos,Super Wings, all good food with no fire code taste. Great Adventure is in PA not Brooklyn. There is no sneaking up on opening up a 275 person bar w no planning in the ghetto. There is no 100 person liquor serving est within the area.There was never a petition. Dear res we are opening a 275 person night club do you object? WTF.     I hope I look that good with a pancake on my head. My post was an example of many things. First being the inability to transfer anger into a typed form here is another try this time without single malt.

    The National Electric Code(NEC) has federal standards for Places Of Assembly(POA). Churches, movie theaters, night clubs,ect. The Authority Having Juristiction (AHJ), the AHJ in this case NYCDOB/FDNY. The AHJ can impose a higher standard but never a lesser one as they are doing here. There are very clear rules about lighting,exits and safety systems that must be in place at POA's of @275 people. The architect being used by the owner of Franklin Park/ Dutchboy should be using the section of the NEC./NFPA 72. If and when there is an accident/fire or robbery at this location I would hope that anyone harmed would sue for damages as a result of poor code compliance. The doors,signage and safety systems at a POA with a capacity of 275 look much different from the ones currently in use at the 3 Franklin Park building. As in recent tragic accidents in bars and nightclubs where there is loss of life the code violations are many and deadly. Curious how a person in the restroom at Franklin Park knows there is a fire condition inside Dutch Boy? He or she should know if that is the exit they entered and could use during an emergency.

  • Ok- so what I'm thinking is- the kitchen's open- the actual SPACE is not.

  • Last night they were serving hamburgers and such off a grill, despite the restaurant space still being closed.

    ...leading me to believe that they may be able to create more exciting food than burgers without the use of the closed space.
