I contacted the DOB again explaining the differences in addresses and gave them both bins (3335886 - 235 & 3335887 - 257) and told them that our building is under the 235 listing. They replied with the same statement that they were working without a permit which is shown at the 235 property profile under "Violations - ECB (DOB)":
http://a810-bisweb.nyc.gov/bisweb/PropertyProfileOverviewServlet?requestid=5&bin=3335886&allinquirytype=BXS2IQ70
They said that by looking at the updates from 9/21 that it looks like work has been resumed but there are 15+ outstanding things from 2008 and 2009 that need to be fulfilled
I don't want to give misleading info so can someone else verify with the DOB or even the Borough President's office what I said? I'm super confused now. -
I emailed the NYC Rent Guidelines Board <Ask> who refer me to:
DHCR NY Div housing who ref me to the Borogh Prz too. Just left another message for Tonya HIll and am sending an email.
If this is true that the owner is at fault, shouldnt we be able to break our lease? -
I was told by the DOB that it will take them a month or more for them to get all the appropriate sign offs and it usually takes a month or more.
-
I jsut don't understand how they can not tell us even if the move in is next week.
For those of you who had a Sept 1st move in date....what kind of notcies did they give to you? -

I called to check this out. He didn't say anything about a stop work order, and I can't find it on the violations page. He did, however, say that they have not applied for a TCO. He asked a co-worker, who said the same thing. He looked at the "daily sheet" to see if they had applied today, and said that it did not show a TCO application. I don't know what's going on.

And, yeah, he said he's been telling several people a day that there's no TCO application on file. -

If there's no TCO application submitted doesn't that mean we can't move in because of the owners negligence in filing it?
-
Guys,
Lets really do our homework here and understand stuff before we post or communicate to DOB so we dont muddy the water. If it is confusing for us, imagine what it is like on the other end where bureaucracy is at work. we dont want to heap confusion on confusion.
Additionally we are all probably fatigued, sleeping on friends sofas, can't concentrate at work, frustrated and just plain easily spooked. Deep Breaths.
Something to consider is we have one person sort of over seeing the understanding of the what is going on with approvals etc. DOB-Wise and clearly communicating to us. That way there are no knee jerk reactions. Who amongst us feels like they have the best handle on all of this?
That does not mean we don't communicate to them en masse, we just do it smart and coordinated.
United we stand Peeps. -
Quartermass--I agree with you in principal, but I don't think there's much more homework we can do. There's only so much we can understand without relying on the bureaucracy. We don't understand how the process works, and without an architect, we probably won't gain that understanding anytime soon. We can get limited information from the BIS (on DOB's website), but we just don't have any context for it.
I think the best we can do is continue to put pressure on all parties while using what information we do have available to vet what they're telling us. We know that the two parties with the power to get this situation resolved are DOB and BKLYN Gold, so let's give them every reason to want to resolve it as soon as possible. -
I found a link through which you can email the DOB. I suggest everyone send out an email ASAP!

First she told me that she hoped to hear today.
o I checked with the admin office on my move-in - to ask if things get approved if my time set on sept 30 sticks. Admin ref me back to michaela. She said, " If you cannot wait for updated news by end of today or latest Monday, then I suggest you tentatively schedule 9/30 until further notice."
I cant imagine they didn't file a TCO and would say that...i have to have hope. Until I the lawwyer anyway. lol -

How dare you be so nosy about whether you will have a home next week! -
Gorupon's daily deal: 72% Off at Manhattan Mini Storage...looks like we may need it. Ugh. Was supposed to move in today,
-
E-mail I received today:

I heard Avalon gave $100/day concessions to people who were delayed one week.

We expect positive news from the DOB early next week and will advise you immediately.
The owner is offering a $500 American Express Card to the tenants with a September 1st lease date due to any inconvenience or additional expenses you may have occurred during this delay. (1 card per apartment) You should receive it shortly after you move in.
Once again we thank you for your patience.
Michaela -
Well that's positive. Maybe confirmation is coming soon!
-
I also received the email from Michaela but she didn't mention anything about any positive news.

That's strange, Enzo. At what times did you guys get it?
-
well i actually e-mailed her first asking if there were any updates. maybe she was just lying to me and giving me false hope as usual because i was bothering her about it.
-
i got it around 11 am this morning (saturday)
-
I got it around 2 PM yesterday.....

That probably explains it? Let's hope we hear tomorrow. -
I was at bkgold this weekend. I was thinking of switching to a different apartment. They all seems surprised to have not heard anything on Friday. they seem to be sincere when they said expect to hear today. At this point, i don 't care just want to know either way.
I hope to know today so i can start packing...either way i have to move out of my current location thursday... would be easier to pack if i know where i am going. lol
Lets all think very positive on this vvery rainy day. -
Do you think it's realistic that we'll really hear today?
-
It's so quiet today! This is sucking up so much energy. I really hope we get some good news today.
-
Realistically i think we will hear on Tuesday per their usual pattern. I hope it is not another form email and it contains a real update instead of the usual line. i am four weeks homeless away from my belongings (like rain boots!) and very discouraged. I can not imagine how the ones who have been at this longer are doing it.
Its bad enough to do this waiting game, but with no hard date it is maddening and a 500 dollar gift certificate is nice, but hardly makes up for paying thousands of dollars for the privilege of being homeless. Trying to stay positive, but god i miss living like a human being instead of a college drop out on some ones couch. -

I don't understand how they can be waiting day-to-day, have everything in, and yet still randomly "expect" news on certain days (i.e., she told someone that she expects positive news early this week). What are those expectations based on? And if we don't get positive news today or tomorrow, then what happened?

I'm already planning to stay where I am another month.

What are you doing to do if they come back tomorrow and say they've got the TCO, your lease is starting this week? Did you already pay rent on the other place? -
If anyone wants to be really adventurous/annoying, I think this is their actual expeditor for the DOB process:
Name:NATHAN B SILBERMAN
Business Name:CONSTRUCTION CONSULTING ASSOC.Business Phone:212-385-1818
Found it on the Building Information System.
